Yakventure — Liability Waiver Declaration

The undersigned (hereinafter referred to as "Participant"), acting on my own behalf and on behalf of anyone who might seek liability from ASSOCIATION "SPORTS CLUB KAYAK VENTURE", UIC 205962391, hereby declare, as of the date written below, that:

1. 1. I release from liability and waive the right to bring before a court or otherwise any claims against ASSOCIATION "SPORTS CLUB KAYAK VENTURE", their partners, managers, employees, members of the board of directors (hereinafter referred to together with ASSOCIATION "SPORTS CLUB KAYAK VENTURE" as the "Released Parties"). This release does not apply to liability arising from intentional acts (intent) or gross negligence of the Released Parties.
2. 2. I voluntarily wish to participate in an event (adventure) with watercraft and motor vehicles, organized by ASSOCIATION "SPORTS CLUB KAYAK VENTURE".
3. 3. I accept the requirement that signing and submitting this declaration is a precondition for participation.
4. 4. In full awareness, understanding the nature and significance of the declared, I expressly confirm and accept that I am aware that the activities of the "Event" are associated with risk of injury and/or death and/or property damage, and I expressly assume this risk. I confirm that I have disclosed to a representative of the ASSOCIATION full details of my health condition and declare that I do not suffer from diseases or conditions equivalent to diseases (including addictions such as alcoholism, drug addiction, etc.) that would endanger my life, health and safety, as well as that of the other participants, and that I do not require special care or any medical supervision or treatment. I agree that if necessary, "SPORTS CLUB KAYAK VENTURE" may consult a doctor to assess my suitability for participation in the Adventure, and regardless, I agree and declare that my participation is entirely at my own risk.
5. 5. I unconditionally and irrevocably release each of the Released Parties from any claims, demands, grounds for filing lawsuits, obligations, actions, damages and injuries, in case of death, injury, full or partial disability, damage or destruction of property, as well as medical expenses; theft, loss, damage to luggage or other personal property of the Participant, caused by or otherwise related to the Participant's participation in the Adventure. I expressly agree that the foregoing includes Claims arising from negligence of any of the Released Parties, of another participant in the Adventure, and that the foregoing is comprehensive, to the extent possible under applicable law, except for those caused by fault or gross negligence of the Released Parties and compensable on that basis.
6. 6. My registration for participation in the Adventure meets all legitimacy requirements and I have no criminal convictions preventing me from leaving the Republic of Bulgaria.
7. 7. I undertake to attend a briefing and training session, which will be conducted by a member of the ASSOCIATION before the start of the event. I agree and unconditionally accept to comply with safety rules while traveling by motor vehicles, as well as while moving by boat on water. I undertake to strictly follow the instructions of the guides during water crossings. In this regard, the Organizer has the right to make remarks and, in case of gross non-compliance with instructions, to resort to my removal from the "Adventure", in whatever manner they see fit, for the benefit of my safety, the safety of other participants, or the protection of the environment.
8. 8. I undertake and accept not to initiate, assist, or cause the seeking of civil or criminal liability from any of the Released Parties in the form of a lawsuit, or in any other form for the realization of Claims, except in cases of intentional fault or gross negligence.
9. 9. I acknowledge that the operator holds mandatory accident insurance ("Застраховка Злополука") for participants per the Law on Attraction Services. I understand the scope of this insurance does not replace my own travel/health insurance.
10. 10. Participants under 14 years of age must be accompanied by a parent or legal guardian, who accepts this declaration on the minor's behalf. Participants aged 14-17 require parental consent.
11. 11. I agree that acceptance of this declaration through the electronic checkbox on yakventure.net constitutes a valid electronic signature equivalent to a handwritten signature, in accordance with the Electronic Document and Electronic Trust Services Act and Regulation (EU) No 910/2014 (eIDAS).
12. 12. This declaration constitutes an informed consent declaration as required by the Law on Attraction Services.
13. 13. I accept that the legislation of the Republic of Bulgaria (without choice of its legal provisions) shall apply to the terms of this declaration in all cases. Claims by the parties hereto may only be brought before the courts in the Republic of Bulgaria and before no other jurisdiction.
14. 14. I accept that all amendments and supplements to this Liability Waiver Declaration by me shall be considered invalid unless they are in written form and signed by the Participant and "SPORTS CLUB KAYAK VENTURE".
15. 15. If any provision of this Declaration is found to be illegal, invalid or unenforceable, such provision shall be deemed fully severable, and the Declaration shall be interpreted and applied as if the provision in question had not been part of it; the other provisions of the Declaration shall remain in force, unaffected by the invalid or unenforceable provision, or by its severance from the Declaration.
16. 16. This declaration applies to the selected adventure.
17. 17. In accordance with Regulation (EU) 2016/679 (General Data Protection Regulation — GDPR), I consent to the collection, processing, and storage of my personal data (name, contact details, health information, emergency contact) by ASSOCIATION "SPORTS CLUB KAYAK VENTURE" solely for the purposes of organizing and conducting the adventure, ensuring participant safety, and fulfilling legal obligations. My data will be retained for a period of 3 years after the adventure date. I understand that my data will not be shared with third parties except where required by law or necessary for medical emergencies. I have the right to request access to, correction of, or deletion of my personal data at any time by contacting [email protected]. I also have the right to lodge a complaint with the Commission for Personal Data Protection (CPDP). Withdrawal of consent for data processing does not affect the lawfulness of processing carried out prior to the withdrawal. For participants under 14 years of age, parental or guardian consent is required for data processing.
